Terms & Conditions

Effective Date: Last Updated:

This Site is under construction.

We plan to release more features shortly. Until then, some parts of the Site are not available, and these Terms cover only what the Site offers today. We will update these Terms when we add features. See Section 2 for the list of what is available now.

1. Who We Are and What These Terms Cover

These Terms & Conditions (“these Terms”) are an agreement between you and The Robinson Cemetery Association of Hannibal, Missouri (the “Association,” “we,” “us,” and “our”). The Association is a nonprofit organization established on January 1, 2022. It is recognized as tax-exempt under section 501(c)(3) of the Internal Revenue Code. The Association preserves and maintains the Edward Robinson Cemetery, also called Robinson Cemetery (the “Cemetery”), at 1204 Clark Avenue, Hannibal, Marion County, Missouri 63401.

These Terms use the following defined words:

  • “Site” means the website at robinsoncemetery.org and every page on it.
  • “You” means any person who visits or uses the Site.
  • “Submission” means any information, text, photograph, document, or other material that you send to the Association by email or through the contact form on the Site.

Read these Terms before you use the Site. By using the Site, you agree to them. If you do not agree, stop using the Site.

These Terms apply to the Site only. They do not apply to visits to the Cemetery grounds, interments, plots, burial rights, or other cemetery services. If a separate written agreement or rule applies to one of those matters, that agreement or rule controls for that matter. Contact us at info@robinsoncemetery.org for details.

3. Using the Site

You may use the Site for lawful personal, family, educational, genealogical, and memorial purposes, and to learn about and support the Association.

You must not:

  1. Break any law, or use the Site to help another person break a law.
  2. Harass, threaten, or abuse any person, including Association volunteers and officers and the families of those buried in the Cemetery.
  3. Send or post content that you know is false or misleading, or that is defamatory or discriminatory.
  4. Pretend to be another person, or claim a family, ownership, or legal connection to a grave or plot that you do not have.
  5. Send viruses, spam, or other malicious software, or try to gain unauthorized access to the Site or its servers.
  6. Interfere with the operation or security of the Site.
  7. Copy, scrape, or republish Site content in bulk, or use it for commercial purposes, without our written permission.
  8. Send content that infringes the copyright, trademark, privacy, or other rights of any person.

If you break these rules, we may restrict your access as described in Section 10.

4. Information You Send Us (Submissions)

You may send Submissions to the Association by email at info@robinsoncemetery.org or through the contact form on the Site. A Submission must be relevant to the Association and the Cemetery. Examples of relevant Submissions:

  • Biographical or family information about people buried in the Cemetery
  • Photographs, documents, or records about the Cemetery or its history
  • Corrections to information on the Site
  • Questions about burials, graves, plots, headstones, or genealogy
  • Offers to volunteer or donate
  • Other information that relates to the Association’s work

We may delete a Submission that is not relevant, without replying to it.

Private and public Submissions

You decide whether we may share your Submission. These rules apply:

  1. Private Submissions. If you tell us that a Submission is confidential, or that we must not publish it, we keep it private. Only authorized Association directors, officers, and volunteers may see it, and we use it only for the Association’s work. We do not publish it or share it with anyone else, except as the law requires.
  2. Public Submissions. If you tell us that we may publish or share a Submission, we may publish it on the Site or share it as you describe. We never publish your email address or phone number unless you tell us that we may.
  3. No instructions. If you do not tell us whether a Submission may be shared, we treat it as private.
  4. Public comments. When we release comments on grave pages, every comment is public. Do not put private or confidential information in a public comment.

How we review Submissions

  1. A person at the Association reviews every Submission.
  2. We do not use artificial intelligence (AI) or large language models (LLMs) to review or decide on Submissions. Our email and website service providers may use automated tools, such as spam filters, on messages that pass through their systems.
  3. Sending a Submission does not guarantee that we will reply to it, add it to our records, or publish it.
  4. We may decline, edit, correct, or remove any Submission that we publish, to keep our records accurate and respectful.

Your responsibilities

When you send a Submission, you confirm that:

  1. You own the Submission, or you have permission to share it with the Association.
  2. To the best of your knowledge, the information in it is true and accurate.
  3. It does not break the rules in Section 3 and does not infringe the rights of any person.

Our right to use public Submissions

You keep ownership of your Submission. If you allow us to publish or share it, you give the Association a free, non-exclusive, worldwide license to copy, edit, display, publish, and archive it for the Cemetery’s records, preservation, research, education, and the Association’s other nonprofit work. The license for a Submission ends when we delete that Submission under the next heading.

Deleting a Submission

You may ask us to delete a Submission at any time. Email info@robinsoncemetery.org, identify the Submission, and send the request from the email address you used to send it. We may ask you to confirm that you sent it. Within 30 days after we receive your request, we delete the Submission, and we remove it from the Site if we published it, unless the law requires us to keep it.

Privacy and copyright concerns

Our Privacy Policy explains how we handle personal information that you send us.

If you believe that material on the Site infringes your copyright or other rights, email info@robinsoncemetery.org and include:

  1. A description of the material and where it appears on the Site.
  2. Your name and contact information.
  3. An explanation of why you believe it infringes your rights.

We will review your message and respond.

5. Cemetery Information and Records

The Site publishes information about the Cemetery, including its history, genealogy, burial and grave information, and documents. Some of this information comes from old, incomplete, or handwritten records. Some of it comes from Submissions.

Because of this:

  1. The information may contain errors, gaps, or transcription mistakes, such as wrong names, dates, spellings, or locations.
  2. The Site is not the official record of any burial, grave, plot, ownership, or right of burial.
  3. You must not rely on the Site alone to make legal, financial, family, or burial decisions.
  4. To confirm a burial, grave location, plot, ownership, or burial right, contact the Association at info@robinsoncemetery.org before you act.

To report an error, email info@robinsoncemetery.org with the correction and any supporting documents, such as a death certificate, a deed, or a photograph of a headstone. We review each report and update our records when we can verify the correction.

We provide this information for educational, genealogical, and memorial purposes.

The Cemetery is subject to Missouri cemetery law. For a summary, see our Missouri cemetery law page. For information from the state, see the Missouri Office of Endowed Care Cemeteries brochure (PDF).

6. Donations

The Association accepts donations to support the care and preservation of the Cemetery. You may donate in either of these ways:

  1. Online through Zeffy, a third-party donation platform, using the link on our campaign page.
  2. By check. Email info@robinsoncemetery.org for the payee name and mailing address.

Zeffy processes online donations under its own terms and privacy policy. The Association does not collect or store your payment card details on the Site.

Please note:

  1. Donations are voluntary.
  2. A donation does not give you ownership of a plot, a right of burial, or any role in managing the Association or the Cemetery.
  3. The Association is recognized as tax-exempt under section 501(c)(3). Whether your donation is tax-deductible depends on your own tax situation, so ask a tax advisor. Keep your donation confirmation or canceled check for your records.
  4. If you set up a recurring donation through Zeffy, you manage it through Zeffy. You may also email info@robinsoncemetery.org for help.
  5. To ask about a donation, including a refund, email info@robinsoncemetery.org.

7. Ownership and Use of Site Content

  1. The text, photographs, graphics, logos, and design of the Site belong to the Association, except for materials that belong to others.
  2. Some materials on the Site, such as the website theme, fonts, software, and historical documents or images, belong to other owners and are used under their own licenses or terms. These Terms give you no rights in those materials.
  3. You may view the Site, and print or save single copies of its pages, for your personal, family, educational, or genealogical use.
  4. Any other use of Site content requires our written permission.
  5. You may not use the name of the Association, the name of the Cemetery, or the Association’s logo to suggest that the Association endorses you or your product, service, or organization, unless we give written permission.

9. Disclaimers and Limits on Our Liability

The Site and all information on it are provided “as is” and “as available,” without warranties of any kind, express or implied. We do not warrant that the Site or its information is accurate, complete, current, uninterrupted, or free of errors or harmful code.

To the fullest extent that Missouri law allows:

  1. The Association is not liable for any loss or damage that results from your use of the Site or your reliance on information on it. This includes mistakes in names, dates, locations, or records, and decisions you make about burials, graves, plots, or family matters.
  2. The Association is not liable for any indirect, incidental, special, consequential, or punitive damages.
  3. These limits also protect the Association’s directors, officers, volunteers, and employees.

Nothing in these Terms limits liability that Missouri law does not allow to be limited, such as liability for intentional misconduct.

10. Changing the Site and Ending Access

  1. We may change, suspend, or discontinue any part of the Site at any time, for any reason. Reasons include restoration work, improving the Site, and complying with the law.
  2. We may block your access to the Site, and delete your Submissions, if you break these Terms or if we reasonably believe that your use harms the Site, the Association, or other people. We may do this without notice.
  3. You may stop using the Site at any time.
  4. If your access ends, you must stop using the Site.
  5. These sections continue after your access ends: Section 4 (including the license and deletion rules), Section 5, Section 7, Section 9, and Section 12.

11. Changes to These Terms

We may change these Terms at any time. When we do:

  1. We post the new version on this page.
  2. We change the Last Updated date at the top of this page.
  3. The change takes effect on the date we post it, unless the new version states a later date.

If you keep using the Site after a change takes effect, you accept the new Terms. If you do not accept them, stop using the Site. Check this page regularly for changes.

12. Governing Law, Courts, and General Terms

  1. Missouri law governs these Terms and any dispute about the Site, without regard to conflict-of-law rules.
  2. Any lawsuit about these Terms or the Site must be filed in the state courts located in Marion County, Missouri, or, if a federal court has jurisdiction, in the federal court whose district includes Marion County, Missouri. You and the Association consent to the jurisdiction of those courts.
  3. The Association operates the Site from the United States for people in the United States. We make no promise that the Site is appropriate or available for use in other countries. If you use the Site from outside the United States, you do so on your own initiative and you are responsible for following your local laws.
  4. If a court finds that any part of these Terms cannot be enforced, that part is limited to the extent necessary, and the rest of these Terms stay in effect.
  5. These Terms and our Privacy Policy are the entire agreement between you and the Association about the Site. They replace all earlier versions of both documents. If these Terms and the Privacy Policy conflict about how we handle personal information, the Privacy Policy controls.
  6. If we do not enforce a part of these Terms, we do not give up our right to enforce it later.
